TikTok Settles Child Privacy Lawsuit for $400 Million

TikTok will pay $400 million to settle DOJ lawsuit alleging violations of children's privacy laws.

The update

TikTok has agreed to pay $400 million to settle a lawsuit brought by the Department of Justice alleging violations of the Children’s Online Privacy Protection Act (COPPA). The settlement is one of the largest recoveries ever obtained in a COPPA case. Under the terms, TikTok will pay $300 million immediately and an additional $100 million after a prior agreement with the FTC is vacated.

Why it matters

The settlement resolves significant privacy concerns about how TikTok handled data from users under 13. The DOJ alleged that TikTok collected data from children without notifying parents or obtaining consent and failed to delete accounts when parents requested. This case sets a precedent for how social media platforms must handle children’s data and could influence future privacy regulations.

What to watch

Regulatory implementation of TikTok’s new ownership structure and privacy practices following the settlement. The DOJ noted that TikTok has “undergone significant changes to its ownership, management, compliance functions, and privacy practices” since the lawsuit was filed. The company has created a new entity for its US business, TikTok USDS Joint Venture, controlled by investors including Oracle, Silver Lake and MGX. ByteDance retained a 19.9 percent stake. The settlement requires TikTok to implement extensive measures to strengthen safeguards for younger users, improve age-related controls, and enhance parental oversight. The timeline for implementing these changes and their effectiveness will be closely monitored by regulators and privacy advocates.
