CFTC Tosses CME Lawsuit Over Crypto Perpetual Futures

The Commodity Futures Trading Commission (CFTC) has filed a motion to dismiss a lawsuit filed by the Chicago Mercantile Exchange (CME) Group. The CME suit challenged the regulator’s approval of cryptocurrency perpetual futures contracts, specifically those tied to Kalshi’s Bitcoin product.

Lawyers for the CFTC argue that the exchange lacks standing to sue. They contend the CME has not shown it suffered concrete financial harm or faced greater competition because of the CFTC’s decision. The filing states that any CFTC-registered exchange, including CME, is permitted to list perpetual futures on digital assets.
