Austria Issues First MiCA Fine to Bitpanda

Austria's financial regulator fines Bitpanda €70,000 for violating new EU crypto rules.

The update

Austria’s Financial Market Authority (FMA) has fined crypto platform Bitpanda €70,000 for violating the European Union’s Markets in Crypto-Assets (MiCA) regulation. This marks the first published penalty under MiCA, with the regulator citing Bitpanda’s failure to submit a mandatory white paper at least 20 working days before publication and omitting required disclosures in marketing materials. The proceedings were concluded under an expedited procedure, and the penalty is final.

Why it matters

This enforcement action signals that EU regulators are beginning to actively enforce MiCA requirements, which establish a harmonized regulatory framework for crypto assets across Europe. The fine targets one of Europe’s largest crypto brokers, indicating that compliance with disclosure, marketing, and authorization requirements will be strictly enforced. Bitpanda characterized the violations as “timing and formal specifications” and has since corrected the issues following a “consensual conclusion.”

What to watch

How other EU regulators follow Austria’s lead in enforcing MiCA rules, whether Bitpanda’s characterization of the violations as “timing and formal specifications” becomes a common defense strategy, and how this impacts crypto marketing practices across Europe. The case may set precedents for future enforcement actions under the new regulatory framework.
